The Short Answer
Is weed legal in the Florida Keys? Recreational weed and recreational marijuana are not legal for purchase or possession merely because someone is 21 or older. Florida permits medical marijuana for qualified patients within the state's regulated medical marijuana program.
If Weed Is Not Recreationally Legal, Why Does Key West Seem Like It Is?
That is a fair question. Walk around Key West—especially near busy nightlife and festival areas—and you may smell marijuana, see people using it, or notice businesses advertising cannabis and hemp products. It can easily give visitors the impression that recreational weed is legal.
The plain-talk answer is that something being common or openly visible is not the same as it being legal. Some people may be registered Florida medical marijuana patients. Some products may be hemp-derived. Other people may simply be taking a legal risk. You cannot reliably tell the product—or whether someone is following the law—just by seeing or smelling it.
Key West's relaxed atmosphere does not override Florida law. A visitor who is 21 or older cannot legally purchase recreational marijuana from a Florida dispensary, and even qualified medical patients generally cannot smoke or use marijuana openly in public places.
Florida Statute §381.986 governs the state's medical use of marijuana. The Florida Office of Medical Marijuana Use explains that licensed Medical Marijuana Treatment Centers, commonly called MMTCs or dispensaries, are the businesses authorized by Florida to cultivate, process, and dispense medical marijuana to qualified patients.
Is Recreational Weed or Marijuana Legal?
No. Florida has a medical marijuana program, but it does not have legal recreational marijuana sales. A tourist cannot legally walk into a Florida Keys dispensary and purchase weed using only proof that the person is 21 or older.
Medical marijuana purchases at a Florida MMTC require an active order in Florida's Medical Marijuana Use Registry for a qualified Florida patient or caregiver.
Do Florida Dispensaries Accept Out-of-State Medical Cards?
No. Florida does not offer medical marijuana reciprocity. An out-of-state marijuana card does not authorize purchases from Florida MMTC dispensaries. The Florida Office of Medical Marijuana Use states that Florida MMTCs dispense only to qualified Florida patients and caregivers with an order in the state's Medical Marijuana Use Registry.

Can a Seasonal Florida Resident Qualify?
Possibly. Florida's medical marijuana statute includes a seasonal-resident pathway. Under §381.986, a seasonal resident generally must temporarily reside in Florida for at least 31 consecutive days in a calendar year, maintain a temporary Florida residence, return to another state or jurisdiction at least once during the year, and be registered to vote or pay income tax elsewhere. Documentation and all other program requirements still apply.
A vacation by itself does not automatically make someone eligible for a Florida medical marijuana card.
Is Marijuana Legal in Key West?
Key West is part of Florida, so Florida marijuana law applies. Key West has licensed medical marijuana dispensaries, but those locations serve qualified Florida patients and caregivers—not general recreational customers or visitors using another state's card.
The same basic rule applies throughout Monroe County, including Key Largo, Tavernier, Islamorada, Marathon, the Lower Keys, and Key West.
Visiting Key West for Fantasy Fest?
Fantasy Fest brings visitors from around the world to Key West, but the festival does not create an exception to Florida weed or marijuana laws. Recreational marijuana remains illegal, and an out-of-state medical marijuana card does not authorize a visitor to buy from a Florida medical marijuana treatment center.
Public streets, sidewalks, festival areas, beaches, parks, and other places open to the public should not be treated as legal places to smoke or use marijuana. The same Florida public-use restrictions apply during Fantasy Fest as at any other time. Private venues, hotels, and vacation rentals may impose additional no-smoking or no-marijuana rules.

Can I Smoke or Use Marijuana in Public?
Florida Statute §381.986 excludes most use or administration of marijuana on public transportation and in public places from protected “medical use.” The statute contains a limited exception for certain non-smoked low-THC cannabis. Beaches, parks, sidewalks, attractions, and other areas open to the public should not be treated as legal marijuana-use areas.
Private-property owners can restrict smoking or vaping marijuana on their property. Hotels, vacation rentals, employers, marinas, and other businesses may also impose their own lawful rules. Florida law does not require an employer to accommodate marijuana use in the workplace.
What If Someone Possesses Marijuana Outside the Medical Program?
Florida Statute §893.13(6)(b) classifies possession of 20 grams or less of cannabis, when no lawful exception applies, as a first-degree misdemeanor. Larger quantities, concentrated products, distribution-related conduct, or other circumstances may be treated differently and can carry substantially more serious consequences.
Do not use this summary to determine whether a particular product, quantity, or situation is lawful. Product type, source, amount, packaging, intent, and a person's status under Florida law can all matter.
Can I Bring Weed or Marijuana Into the Florida Keys?
Do not assume marijuana that is legal in another state can be transported into Florida. State borders involve federal jurisdiction, and the Florida OMMU notes that marijuana remains illegal under federal law. Transporting marijuana by car, aircraft, or boat can raise separate state and federal issues.
Driving and Boating
Participation in Florida's medical marijuana program does not authorize impaired driving or boating. Section 381.986 specifically states that its protections do not exempt a person from prosecution for an offense related to impairment or intoxication resulting from medical marijuana use.
Can Florida Patients Grow Their Own Marijuana?
Florida's medical program does not authorize patients to grow marijuana at home. Section 381.986 provides that the state may revoke a patient's registration for cultivating marijuana or acquiring it from a source other than a licensed MMTC.
What About Hemp-Derived THC Products?
Hemp products are governed under a separate legal framework, including Florida Statute §581.217 . A product marketed as hemp is not automatically lawful, safe, or the same as medical marijuana. Product composition, testing, labeling, age rules, and later legal changes can affect its status.
